IT contractors 'should avoid HMRC contract reviews'
IT contractors should only ask for a contract review from HMRC when all other avenues of advice have been exhausted.

This is the view of information site Contractor Calculator, which claims that requesting such a review can leave an IT contractor exposed to further action from the taxman should it be found to be within the remit of IR35.

Getting HMRC to review the contract involves submitting a substantial amount of additional 'relevant' information, which can make the process arduous.

In addition, any IT contractors who dispute the HMRC's IR35 decision may find themselves in a lengthy appeals process that can take years.

"It is recommended that contractors should only request a contract review from HMRC under very specific circumstances and only when an independent IR35 and employment law expert has already reviewed their circumstances," the website states.

In their Programme for Government, the coalition party committed to replacing IR35 with a simpler system, but not timeframe has as yet been set for this new procedure to be finalised.
