IT contractors can take on project manager roles without falling inside the remit of IR35, it has been claimed.

Managing a project often gives the impression of being in disguised employment, according to Contractor Calculator, which of course can lead to an IR35 review an additional tax liabilities and fines.

However, with the right documentation in place and regular updates submitted, it is more than possible to be a project manager outside the scope of that particular piece of tax legislation, claims Kate Cottrell of IR35 experts Bauer & Cottrell.

IT contractors must set out in advance what their fixed roles and responsibilities are and never deviate from them - even just doing a little extra to help out could be seen as a sign of disguised employment, she adds.

Nizar Manek, a writer at the London School of Economics, speculated in a blog published by Reuters that IR35 could be replaced with a General Anti-Avoidance Rule "super law".
