IR35 replacement 'may not please everyone'

Finding a replacement for IR tax legislation that pleases all IT contractors may be an impossible task, it has been claimed.
According to Contractor Calculator, IT contractors can take heart from the fact that new legislation is a top priority for the Office of Tax Simplification (OTS).
However, the difficulty of the challenge is perfectly highlighted by a report the OTS is required to produce for the government.
It must explain why IR35 is too complex and leaves many contractors unsure of their status, as well as considering alternatives that rectify this problem yet continue to defend against tax avoidance, the website notes.
"The OTS faces a potentially insurmountable challenge to find a replacement for IR35 that satisfies each segment of the flexible workforce, as well as end-user clients," said Contractor Calculator chief executive officer Dave Chaplin.
Nizar Manek, a writer at the London School of Economics, recently speculated in a blog published by Reuters that IR35 could be replaced with a General Anti-Avoidance Rule "super law".
