Celebrations over the death of IR35 'are premature'
IT contractors who celebrated the beginning of the end for the much-maligned IR35 legislation have done so a little prematurely, it has been claimed.

Writing for ContratorCalculator.co.uk, the firm's chief executive officer Dave Chaplin reminds contractors that the government promised to review the legislation, without making guarantees it would be replaced immediately.

After all, IR35 does not exist in isolation - it forms part of a much larger system of tax-avoidance legislation.

As the new coalition government has promised to crack down on tax-evaders, it is likely that it will want to review all related legislation - which makes implementation of an IR35 replacement highly unlikely before April 2011, Mr Chaplin concludes.

In its Programme for Government, the new Conservative-Liberal Democrat coalition announced that it would look to replace IR35 with "simpler measures" that do not put unnecessary pressure on self-employed people or the flexible labour market itself.
